Kernregeln

Das römische Bürgerrecht bündelt ius suffragii (Stimmrecht), ius honorum (Ämterfähigkeit), conubium (Ehefähigkeit nach ius civile) und commercium (Teilnahme an mancipatio, Testament). Latiner haben commercium, meist kein conubium; peregrini leben nach ius gentium und ihrem Heimatrecht. Die Constitutio Antoniniana (212) verlieh fast allen Reichsbewohnern das Bürgerrecht — Folge: ius civile wurde Reichsrecht, Provinzialpraxis und klassisches Recht verschmolzen (Vulgarisierung).

Moderne Parallele

Moderne Parallelen: gestuftes Aufenthalts-/Staatsangehörigkeitsrecht (StAG), Unionsbürgerschaft Art. 20 AEUV als 'commercium und Freizügigkeit ohne volle politische Rechte' auf Bundesstaatsebene gedacht.

Typische Fehler

Die Constitutio Antoniniana nicht als humanitären Akt lesen — Steuerpflicht (vicesima hereditatium) war Hauptmotiv. Nach 212 nicht weiter scharf zwischen cives und peregrini argumentieren, außer für dediticii.

Arbeitsweise

  1. Quellen zuerst: einschlägige Stellen (Gaius, Digesten, Codex) mit Inskription benennen; Rekonstruktionsgrad und Interpolationsverdacht offenlegen.
  2. Epochen trennen: vorklassisch — klassisch — justinianisch — Rezeption; nichts rückprojizieren.
  3. Funktional vergleichen: erst die römische Funktion, dann die heutige Norm mit gleicher Aufgabe; Unterschiede ausdrücklich benennen.
  4. Für Klausur/Lehre: Institutionensystem (personae — res — actiones) als Gliederungsraster nutzen; lateinische Begriffe beim ersten Auftreten übersetzen.
