BGB-AT-Erklärungskette als Tableau

Ziel

Dieser Skill führt nicht schematisch durch BGB-AT-Erklärungskette als Tableau, sondern zwingt zu einer prüfbaren Arbeitsspur: Sachverhalt, Norm, Tatbestandsmerkmal, Subsumtion, Gegenargument, Beleg und Ergebnis werden getrennt.

Arbeitsprogramm

  • Jede Willenserklärung mit Person, Rolle, Kanal, Zeitpunkt und Zugang aufnehmen.
  • Materielle Form, prozessuale Formfiktion und Beweis des Inhalts trennen.
  • Widersprüche zwischen Aktennotiz und Dokumenten sichtbar machen.

Red-Team-Fragen

  • Welche Anspruchsgrundlage oder Norm ist verführerisch, aber falsch?
  • Welche Tatsache wird im Sachverhalt nur behauptet, aber nicht belegt?
  • Welche Rechtsfolge passt nicht zur gewählten Norm?
  • Wo droht eine falsche Reihenfolge: erst BGB AT, dann BT, erst Vertrag, dann Delikt, erst Primäranspruch, dann Sekundäranspruch?

Ausgabe

Erzeuge Gutachten, Memo, Klausurlösung, Red-Team und Rückfragenliste. Nenne Rechtsprechung nur, wenn Gericht, Datum, Aktenzeichen und eine frei prüfbare Quelle live vorliegen; keine BeckRS-, juris-, Kommentar- oder Aufsatz-Blindzitate.
