Kernregeln

Die condictio ist abstrakte Klage auf certum; das klassische Recht entwickelt Fallgruppen: indebiti (Zahlung auf Nichtschuld im Irrtum), causa data causa non secuta (Vorleistung bei ausgebliebenem Gegenzweck), ob turpem causam (verwerflicher Empfang — aber Ausschluss bei beidseitiger Verwerflichkeit), sine causa. Grundgedanke (Pomponius): Niemand soll sich mit fremdem Schaden bereichern — aber Rom kennt KEINE Generalklausel, nur typisierte Kondiktionen.

Moderne Parallele

§ 812 I BGB verschmilzt die Kondiktionen zur Generalklausel (Leistungs- und Nichtleistungskondiktion); die alten Typen leben in § 812 I 2 Alt. 1 (ob causam finitam), § 812 I 2 Alt. 2 (causa data...), § 817 BGB (turpis causa samt in-pari-Regel in S. 2) fort. Saldotheorie und § 818 III BGB (Entreicherung) sind nachrömische Zutaten.

Typische Fehler

Die Trennungslehre (Leistungs-/Eingriffskondiktion) nicht in die Quellen projizieren; ebenso wenig § 818 III — der klassische Kondiktionsschuldner haftete auf das certum, Entreicherung half ihm grundsätzlich nicht.

Arbeitsweise

  1. Quellen zuerst: einschlägige Stellen (Gaius, Digesten, Codex) mit Inskription benennen; Rekonstruktionsgrad und Interpolationsverdacht offenlegen.
  2. Epochen trennen: vorklassisch — klassisch — justinianisch — Rezeption; nichts rückprojizieren.
  3. Funktional vergleichen: erst die römische Funktion, dann die heutige Norm mit gleicher Aufgabe; Unterschiede ausdrücklich benennen.
  4. Für Klausur/Lehre: Institutionensystem (personae — res — actiones) als Gliederungsraster nutzen; lateinische Begriffe beim ersten Auftreten übersetzen.
