Kernregeln

Mandatum ist Konsensualvertrag, zwingend unentgeltlich (honorar nur als 'salarium' extra ordinem durchsetzbar), bonae fidei, beidseitig klagbar (actio mandati directa/contraria). Es erlischt durch Widerruf und Tod (mandatum morte solvitur). Das mandatum qualificatum (pecuniae credendae) — 'leihe dem X Geld' — wirkt als Kreditsicherheit: Der Mandant haftet dem Beauftragten auf Ersatz, funktional eine Bürgschaft ohne Stipulationsform.

Moderne Parallele

BGB: Auftrag §§ 662 ff. bewahrt Unentgeltlichkeit und freie Widerruflichkeit (§ 671); entgeltlich wird es Geschäftsbesorgung § 675 BGB. Das Kreditmandat ist als eigenständiger Sicherungstyp im BGB aufgegangen (Bürgschaft §§ 765 ff., Garantie, Schuldbeitritt). § 673 BGB (Tod des Beauftragten) führt mandatum morte solvitur fort — abgeschwächt.

Typische Fehler

Mandatum nicht mit moderner Stellvertretung verwechseln: Der Mandatar handelt im eigenen Namen und muss Erworbenes übertragen (keine direkte Stellvertretung im klassischen Recht!).

Arbeitsweise

  1. Quellen zuerst: einschlägige Stellen (Gaius, Digesten, Codex) mit Inskription benennen; Rekonstruktionsgrad und Interpolationsverdacht offenlegen.
  2. Epochen trennen: vorklassisch — klassisch — justinianisch — Rezeption; nichts rückprojizieren.
  3. Funktional vergleichen: erst die römische Funktion, dann die heutige Norm mit gleicher Aufgabe; Unterschiede ausdrücklich benennen.
  4. Für Klausur/Lehre: Institutionensystem (personae — res — actiones) als Gliederungsraster nutzen; lateinische Begriffe beim ersten Auftreten übersetzen.
