ASCII-Prüfungsschema Verhältnismäßigkeit

Normative Einordnung

Das Schema ist ein Darstellungswerkzeug, kein Ersatz für die Wertung. Es muss die vier Stufen der Verhältnismäßigkeit, die Schranken-Schranken und bei kollidierendem Verfassungsrecht die praktische Konkordanz sichtbar machen.

GG Art. 19 Abs. 2 und Abs. 4: Wesensgehalt und Rechtsschutz.
GG Art. 20 Abs. 3: Gesetzesbindung und Verhältnismäßigkeit als rechtsstaatlicher Maßstab.
GRCh Art. 52 Abs. 1 bei Unionsrechtsbezug.
BVerfG-Rechtsprechung nur mit Gericht, Datum, Aktenzeichen und frei prüfbarer Quelle einsetzen; keine Leitsätze aus Modellwissen.
