Anspruchstabelle im Zivilprozess

Dieser Skill baut aus einer Akte eine Anspruchstabelle, die Klage, Klageerwiderung, Replik oder Vergleichsstrategie vorbereitet. Er eignet sich fuer Zahlungs-, Leistungs-, Feststellungs- und Unterlassungssachen, wenn mehrere Ansprueche, Gegenansprueche oder Einwendungen nebeneinander stehen.

Normenanker

  • Paragraf 253 ZPO fuer Klageantrag und bestimmten Streitgegenstand.
  • Paragrafen 138, 282, 296 ZPO fuer Vortrag, Wahrheitspflicht und Praeklusion.
  • Paragrafen 286, 287 ZPO fuer Beweiswuerdigung und Schadensschaetzung.
  • Paragrafen 91 ff. ZPO fuer Kostenrisiko.
  • Paragrafen 195, 199, 204 BGB fuer Verjaehrung und Hemmung.

Arbeitsgang

  1. Erfasse jeden Anspruch mit Anspruchsziel, Anspruchsgrundlage, Betrag oder Verhalten.
  2. Ordne die anspruchsbegruendenden Tatsachen und die vorhandenen Belege zu.
  3. Trenne Einwendungen, Einreden und Beweisprobleme.
  4. Nutze references/element-templates.md fuer Tabellenelemente.
  5. Markiere Luecken, die vor dem naechsten Schriftsatz geschlossen werden muessen.

Ergebnis

Liefere eine Tabelle mit Anspruch, Norm, Tatsache, Beleg, Gegnerbestreiten, Beweisangebot, Risikoampel und naechstem Schriftsatzbaustein.
