Worum es geht
Die actio Publiciana ist eine prätorische Fiktionsklage (actio ficticia), die dem Erwerber einer res mancipi ohne förmliche Übereignung Schutz gibt, als ob die Ersitzungszeit bereits abgelaufen wäre. Das Edikt des Prätors fingiert die vollendete usucapio. Sie schützt den bonitarischen Eigentümer gegen den Besitzer (außer gegen den wahren Eigentümer). D. 6.2 (De Publiciana in rem actione) ist der zentrale Titel.
