Kernregeln

Die actio Publiciana schützt den, der auf dem Weg zur usucapio ist (bonitarischer Eigentümer, redlicher Erwerber vom Nichtberechtigten): Der Prätor fingiert die vollendete Ersitzung. Gegen den quiritischen Eigentümer dringt sie nur durch, wenn dieser die exceptio rei venditae et traditae gegen sich gelten lassen muss; gegen gleichrangige Erwerber gilt: prior tempore.

Moderne Parallele

Funktional ersetzt durch §§ 932 ff. BGB (sofortiger gutgläubiger Erwerb) und § 1007 BGB (Anspruch des früheren Besitzers) — letzterer ist die am meisten 'publizianische' Norm des BGB.

Typische Fehler

Die Publiciana ist keine Eigentumsklage zweiter Klasse, sondern eine Fiktionsklage des prätorischen Rechts — ius honorarium und ius civile nicht vermengen.

Arbeitsweise

  1. Quellen zuerst: einschlägige Stellen (Gaius, Digesten, Codex) mit Inskription benennen; Rekonstruktionsgrad und Interpolationsverdacht offenlegen.
  2. Epochen trennen: vorklassisch — klassisch — justinianisch — Rezeption; nichts rückprojizieren.
  3. Funktional vergleichen: erst die römische Funktion, dann die heutige Norm mit gleicher Aufgabe; Unterschiede ausdrücklich benennen.
  4. Für Klausur/Lehre: Institutionensystem (personae — res — actiones) als Gliederungsraster nutzen; lateinische Begriffe beim ersten Auftreten übersetzen.
