Kernregeln
Drei Prozessepochen: (1) legis actiones — Wortformalismus, ein falsches Wort verliert den Prozess (Gaius' Weinstock-Beispiel); (2) Formularprozess — der Prätor gewährt typisierte Klageformeln (intentio: Anspruchsbehauptung; condemnatio: stets auf Geld!), Zweiteilung in iure / apud iudicem, exceptio als formelhafte Einrede (dolus, pactum, metus) macht das strenge ius civile billigkeitsfähig; (3) Kognitionsverfahren — kaiserliche Beamtenjustiz, Instanzenzug, Vollstreckung in Einzelstücke. Das prätorische Edikt ist Motor der Rechtsfortbildung: Es hilft, ergänzt und korrigiert das Zivilrecht (Pomponius) — mit Klagen, Einreden, missiones und in integrum restitutiones.
Moderne Parallele
Das aktionenrechtliche Denken (kein 'Anspruch', sondern 'gibt es eine Klage?') prägt noch heute das Common Law (writ-System als Parallele); das BGB dreht mit § 194 BGB (Anspruchsbegriff, Windscheid) die Blickrichtung. Die exceptio lebt in §§ 214, 273, 320, 821, 853 BGB als 'Einrede' fort; die condemnatio pecuniaria erklärt, warum Rom keine Naturalvollstreckung von Speziesleistungen kannte — anders § 894 ZPO heute.
Typische Fehler
Nicht 'subjektive Rechte' in die Klassik projizieren — der römische Jurist fragt nach actio, exceptio, Formel. Windscheids Anspruchslehre ist die Übersetzung, nicht die Quelle.
Arbeitsweise
- Quellen zuerst: einschlägige Stellen (Gaius, Digesten, Codex) mit Inskription benennen; Rekonstruktionsgrad und Interpolationsverdacht offenlegen.
- Epochen trennen: vorklassisch — klassisch — justinianisch — Rezeption; nichts rückprojizieren.
- Funktional vergleichen: erst die römische Funktion, dann die heutige Norm mit gleicher Aufgabe; Unterschiede ausdrücklich benennen.
- Für Klausur/Lehre: Institutionensystem (personae — res — actiones) als Gliederungsraster nutzen; lateinische Begriffe beim ersten Auftreten übersetzen.
