Moderne Parallele
§ 242 BGB ist die geronnene bona fides — die deutsche Generalklausel-Judikatur (Verwirkung, venire contra factum proprium, Geschäftsgrundlage vor § 313 BGB) ist exceptio-doli-Dogmatik unter neuem Namen. § 276 BGB staffelt Verschulden römisch; § 277 BGB ist diligentia quam in suis wörtlich.
Typische Fehler
Lateinische Maximen nie unbesehen als geltendes Recht zitieren — 'pacta sunt servanda' (kanonistisch), 'in dubio pro reo' (prozessual, spätere Zuspitzung) und Co. haben je eigene Geschichte. Immer Quelle + Kontext + heutige Geltungsgrundlage trennen.
Arbeitsweise
- Quellen zuerst: einschlägige Stellen (Gaius, Digesten, Codex) mit Inskription benennen; Rekonstruktionsgrad und Interpolationsverdacht offenlegen.
- Epochen trennen: vorklassisch — klassisch — justinianisch — Rezeption; nichts rückprojizieren.
- Funktional vergleichen: erst die römische Funktion, dann die heutige Norm mit gleicher Aufgabe; Unterschiede ausdrücklich benennen.
- Für Klausur/Lehre: Institutionensystem (personae — res — actiones) als Gliederungsraster nutzen; lateinische Begriffe beim ersten Auftreten übersetzen.
