Kernregeln

Die XII Tafeln (451/450 v. Chr.) sind kein Gesetzbuch, sondern punktuelle Fixierung umstrittenen Gewohnheitsrechts — Prozessrecht, Vollstreckung, Familien-, Erb-, Nachbar- und Deliktsrecht in knappen Imperativen. Kein Originaltext erhalten: Rekonstruktion aus Zitaten bei Cicero, Gellius, Festus und den Juristen — jede moderne Tafel-Nummerierung ist Konvention (Standardrekonstruktion: Schöll/FIRA). Vorformen italischen Rechts (etruskisch, oskisch — tabula Bantina, faliskisch) sind epigraphisch greifbar und zeigen: Rom war Teil einer italischen Rechtskoine. Pompejis Wände (Wahlaufrufe, Geschäftsurkunden des Iucundus) liefern Alltagsrechtspraxis.

Moderne Parallele

Methodisch wie heute mit fragmentarischer Überlieferung umgehen: Rekonstruktionsgrad stets offenlegen (gesichert / wahrscheinlich / spekulativ), Zitierkonvention nennen. Wer 'Tafel 8.4' zitiert, zitiert eine moderne Hypothese — wie bei jeder kritischen Edition.

Typische Fehler

XII-Tafel-Sätze nicht als wörtliche Zitate ausgeben, wenn nur der Inhalt bezeugt ist; die Nummerierung nicht für antik halten. Und Livius' Erzählung vom Decemvirat ist Literatur, keine Urkunde.

Arbeitsweise

  1. Quellen zuerst: einschlägige Stellen (Gaius, Digesten, Codex) mit Inskription benennen; Rekonstruktionsgrad und Interpolationsverdacht offenlegen.
  2. Epochen trennen: vorklassisch — klassisch — justinianisch — Rezeption; nichts rückprojizieren.
  3. Funktional vergleichen: erst die römische Funktion, dann die heutige Norm mit gleicher Aufgabe; Unterschiede ausdrücklich benennen.
  4. Für Klausur/Lehre: Institutionensystem (personae — res — actiones) als Gliederungsraster nutzen; lateinische Begriffe beim ersten Auftreten übersetzen.
